RA Beauty Retouching Contest

Who May Enter

This contest is open to retouching artists of the Beginner and Experienced Enthusiast level only, as defined below.

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED BY LAW OR REGULATION. A purchase of a product or service from Retouching Academy, Wacom or Capture One or any of their affiliated companies will not improve the chance of winning.

By participating in the Contest, the entrant (“Entrant” or “you”) agrees to be bound by the Official Rules (“Rules”) of the Contest.

Eligibility

PARTICIPANTS MUST BE AT LEAST THE AGE OF MAJORITY IN THEIR STATE AT THE TIME OF ENTRY. Employees, officers, and directors of Sponsors, Retouching Academy, their parent, subsidiary, affiliated or related companies, and all other entities associated with the creation, administration, promotion or fulfillment of the Contest, and each of their respective parent, subsidiary, affiliated and related companies (collectively, the “Contest Entities”), and each of their immediate family members and persons residing in the same household of such family members are not eligible to enter or win the Contest. All eligibility is subject to all federal, state, and local laws and regulations.

Contest Skill Levels

The Contest will be judged based on the following skill levels by Retouching Academy and the Contest sponsors, Wacom and Capture One (“Sponsors”), in their sole discretion:

1. Beginner – a hobbyist retouching artist who is still learning the basic beauty, portrait and fashion retouching techniques.
2. Experienced Enthusiast – a retouching artist who has a good understanding of the key beauty, portrait and fashion retouching techniques and at least two years of experience in performing them for his or her own portfolio, clients or as a hobby.

How To Enter

Register to participate here.

After submitting your registration form, you will be provided with the RA Beauty Retouching Contest image file along with the submission instructions.

Maximum one entry (“Entry”) per person/email address (“Address”), regardless of whether one person has more than one Address or more than one person uses the same Address. Participants who submit more than one retouched image will be disqualified. The Submission must be retouched by you only.

The retouched image must be submitted in JPEG format, at 2,000 pixels along the long edge and no larger than 10 MB.

Please only submit files named as follows: RA_YourCategory_YourFirstName_YourLastName.jpg. (for example, RA_Beginner_Joe_Smith.jpg).

Please only submit a link to your retouched image hosted on a remote storage website such as Dropbox or Google Drive via our Submission page; We do not accept images submitted through any means other than as set forth in the submission instructions.

When submitting your Contest entry, you must provide your artist name, your Instagram tag and city of residence. We will only use this information in relation to the Contest and will not use it for any other purposes. We will not keep this information for longer than is necessary for the operation of the Contest.

All Submissions must comply with the Submission Guidelines set forth in these Rules and will be subject to disqualification for failure to do so, at the Sponsors and Retouching Academy’s sole discretion. Normal Internet access and usage charges imposed by your Internet service may apply. Entry in this Contest does not constitute entry into any other promotion.

Submission Notes & Deadline

The Contest begins on May 1, 2018 at 7:59 am Pacific Time, and ends on May 15, 2018 at 11:59 pm Pacific Time (the “Contest Period”). We must receive your entry to the Contest by 11:59 pm Pacific Time on May 15, 2018.

Entries on behalf of another person will not be accepted.

Contest Images

The contest images are photographed by Julia Kuzmenko and Michael Woloszynowicz exclusively for Retouching Academy in Los Angeles, CA. Michael’s photographs are captured with a Phase One IQ250 camera, and Julia’s with a Canon 5DS.

The Contest Image files provided by Retouching Academy to entrants may not be used for any purposes, other than participation in the Contest.

When the Contest Image and/or the participant’s retouched version are shared on social media, the copyright ownership must be clearly stated ©Retouching Academy.

Copyright and Other Legal Rights

The copyright of the Contest images belongs to Retouching Academy, owned by Queenscliff Global LLC, California.

You will be granted the right to post your completed retouch to your own website and/or social media, provided proper copyright is clearly stated ©Retouching Academy.

By submitting an entry to the Contest, you grant Retouching Academy and the Contest sponsors permission:

a) For your entry to be published within the RA, Wacom and Capture One websites, newsletters and social media, and grant them a non-exclusive, royalty-free, irrevocable, perpetual worldwide license to republish your Contest entry, in whole or in part, in electronic format and hard copy in any way the Sponsors see fit including, but not limited to, entertainment, instruction/education, promotional, advertising and/or marketing purposes;

b) In connection with all rights granted in these Rules, Retouching Academy and Sponsors (and Sponsors’ licensees and assigns) also have the irrevocable right to incorporate Submissions, in whole or in part, into other works, in any form, media or technology now known or hereafter developed, and

c) The right to use your name, city of residence and the tools used to create your work for the sole purpose of identifying you as the author of your Entry.

Retouching Academy or the Sponsors will not be required to pay any additional consideration or seek any additional approval in connection with such uses.

If necessary, you agree to sign any necessary documentation that may be required for Retouching Academy, Sponsors or their designees to make use of the non-exclusive rights you are granting them in the Submission.

You also agree that any creative ideas, suggestions or other materials you submit in connection with this Contest, in any form, are not being made in confidence or trust and that no confidential or fiduciary relationship is intended or created between you and us in any way, and that you have no expectation of review, compensation or consideration of any type.

Your participation in the Contest and the Entry are subject to all federal, state, and local laws.

Retouching Academy or the Sponsors may select images for highlight on their websites or display in a publicly accessible Contest archive; such selections will be made in Retouching Academy’s or the Sponsors’ sole discretion.

Picking The Winners

Retouching Academy, along with Wacom and Capture One, will select a First and Second Prize winner for each skill level, and the social media Bonus Prize winner. The judging will occur on or around May 16, 2018 to May 31, 2018. Public announcement of the winners will occur no later than June 1, 2018.

The winning entries will be those that Retouching Academy, Wacom and Capture One consider to be the best retouched. Quality retouch is all about preserving skin texture, while achieving a pleasing skin tone and removing or minimizing distracting, unflattering elements commonly acceptable for the genre. The panel of judges will judge the qualifying Submissions according to these criteria (the “Judging Criteria”).

The judging and final determination of the Winners will be in the sole discretion of the Judges. The Judges reserve the right to extend the Contest Period if they determine, in their sole discretion, that entries received did not meet the qualification standards based on the Judging Criteria.

Retouching Academy will notify winners via the contact information provided at the time of entry. If any potential Winner: (A) does not respond within seventy-two (72) hours of the first notification attempt; (B) is found to be ineligible or any reason; (C) fails to return a prize notification, or declines a prize for any reason; or (D) fails to comply with these Rules, such potential Winner will forfeit their Prize and the Sponsors may select an alternate Winner from the remaining eligible Entries based on the Judging Criteria set forth above. The final results and winning Entries will be posted on the Retouching Academy website no later than June 1, 2018.

Conditions of Entry

All entrants hold Retouching Academy and the Contest sponsors and their respective agents, directors, officers, employees, contractors, interns, and volunteers (the “Indemnified Parties”) harmless from and against all claims of any nature arising in connection with entrant’s participation in the contest and acceptance or use of a prize. The Indemnified Parties are not liable for any costs, damages, injuries, or other claims incurred as a result of entrant’s participation in the Contest or winner’s acceptance and usage of a prize. The Indemnified Parties are not responsible for incomplete or misdirected entries, technical or network malfunctions or failures, or causes beyond their control. Entrants are solely responsible for their entries.

Entrants may not submit materials that introduce any software viruses, worms or other programs designed to damage software, hardware or telecommunications equipment or are off-topic, partisan-political, contain advertising, nudity, personal attacks or expletives, or is otherwise abusive, threatening, unlawful, harassing, discriminatory, libelous, obscene, false, sexually explicit, or that infringes on the rights of any third party.

Individuals affiliated with Retouching Academy or its sponsors, including employees, contractors, interns, volunteers, and their immediate families (children, siblings and spouses), and others living in their households, are not eligible for any prize.

Participation requires Internet access.

The Contest is void where prohibited or restricted by law. Retouching Academy reserves the right to cancel the Contest or modify these rules at its discretion, with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). In the event of a dispute regarding the winners, Retouching Academy reserves the right to award or not award the prizes in its sole discretion.

Disqualification/Force Majeure

Retouching Academy reserves the right to disqualify any entrant whose entry or conduct appears in any way to: tamper with the Contest; violate these rules or other applicable law or regulation; infringe on the rights of third parties; or act in an unsportsmanlike or disruptive manner. Decisions of Retouching Academy are final.

In the event an insufficient number of eligible entries are received or the Sponsors are prevented from awarding prizes or continuing the Contest as contemplated in these Rules by any event beyond their control (“Force Majeure Event”), including but not limited to fire, flood, natural or man-made epidemic of health of other means, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal state or local government law, order, or regulation, public health crisis, order of any court or jurisdiction, then the Sponsors will have the right to modify, suspend, or terminate the Contest. If the Contest is terminated before the designated end date, the Sponsors will (if possible) select the Winners from all eligible, non-suspect entries received as of the date of the Force Majeure Event giving rise to the termination. Inclusion in such selection process will be each Entrant’s sole and exclusive remedy under such circumstances. Only the type and quantity of Prizes described in these Rules will be awarded.

Disclaimers

The Contest Entities will not be responsible for: (A) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (B) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (C) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Sponsors or Retouching Academy, or by non-authorized human intervention; or (D) any printing or typographical errors in any materials associated with the Contest. ALL PRIZES ARE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY).

General Release

By entering the Contest, each Entrant, for Entrant and for Entrant’s heirs, executors, administrators, successors and assigns: (A) releases and holds harmless the Contest Entities from any liability whatsoever, and waives any and all causes of action, for any claims, costs, injuries, losses, or damages of any kind arising, directly or indirectly, out of or in connection with the Contest or delivery, mis-delivery, acceptance, possession, or use of or inability to use any Prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory; (B) agrees that Contest Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose; and (C) agrees to be bound by these Rules and to waive any right to claim any ambiguity or error in these Rules or in the Contest itself, and to be bound by all decisions of the Sponsors, which are binding and final.

Limitation of Liability

All disputes, actual or alleged claims and causes of action at law or in equity (“Claim(s)”) will be resolved individually, without resort to any form of class action.

Notwithstanding anything to the contrary in these Rules, in connection with any Claims, judgments and awards, you waive all rights to attorneys’ fees, punitive, incidental, special, consequential damages, and to any multiplied damages.

In no event will you be entitled to recover any expenses other than reasonable and actual out-of-pocket expenses.

Retouching Academy and Sponsors’ entire liability and your sole and exclusive remedy will be limited to a distribution of the equivalent amount of Prizes set forth in these Rules.
